Terms of Service

1. Service Description

Tradynx delivers a complete systematic NQ Futures trading system via subscription. Subscribers receive:

• The full Tradynx trading system on their own machine (Trade Agent, News Filter, Drawdown Guardian, Risk Engine, Watchdog)
• License-Key activation tied to active subscription
• Weekly strategy auto-pulled every Sunday from tradynx.com
• Customer-Area access with live performance dashboard
• (Tier 2 Personalized): Custom risk per trade, custom session-window, custom setup-filter, multi-account support, priority email support (24h)
• (Founder Lifetime): All Tier 1 features + multi-account support, lifetime, no recurring fees

Trades execute on the Subscriber's own broker via their own TradersPost connection. Tradynx never touches Customer accounts directly.

2. What Tradynx is NOT

Tradynx is not:

• A licensed financial advisor or RIA (Registered Investment Advisor)
• A broker or executing party — you place trades via your own Tradovate/TradersPost account
• A guarantee of profits or specific returns
• A substitute for your own risk management and judgment

3. Subscription Terms

• Billing: Monthly subscription (Tier 1 $99/mo, Tier 2 $299/mo), charged automatically via Stripe
• Cancel-Anytime: Cancel via Customer-Area or email. Cancellation takes effect at end of current billing period — no pro-rata refunds
• License activation: Customer system requires online License-Key check every 24 hours. Subscription cancellation revokes the License-Key
• Strategy delivery: Sunday by 18:00 UTC, weekly. Customer system auto-pulls. Occasional delays possible if optimizer fails — Customer will be notified
• Pricing changes: 30-day notice before pricing changes for existing subscribers

4. Founder Lifetime License

Founders who purchased the $199 one-time license receive:

• Lifetime access to Tier 1 (Automated) features
• Plus multi-account support (normally Tier 2 only)
• No recurring billing — pay once
• Lifetime weekly strategy updates
• Standard email support (48h)
• Limited to 100 founders globally

Lifetime license is non-transferable and tied to original email address.

5. Performance Disclaimer

All performance figures shown on tradynx.com/track are hypothetical results based on the strategy as published. Actual customer results will vary due to:

• Slippage and broker execution differences
• Different position sizing (we assume 1 NQ contract = $20/point)
• Customer-side delays in following strategy updates
• Account-specific MFFU/prop-firm restrictions

6. Data Privacy

We collect: email address, payment information (via Lemonsqueezy — we don't store card data), and subscription status. We do NOT collect: your trading account, your actual P&L, your account balances, or any personal data beyond what's needed for service delivery.

Subscription data may be processed in the EU/Germany under GDPR. Contact [email protected] for data export or deletion requests.

7. Anti-Crowding

To prevent multiple customers executing the exact same trade at the exact same time (which would create artificial market impact and slippage), Tier 2 Webhook-Plugin includes randomized entry-delay (±30 seconds) and slight position-sizing variation. This protects all customers from each other.

8. Termination

We may terminate your subscription if:

• You attempt to redistribute or resell our strategies
• You reverse-engineer the webhook-plugin or scrape the customer-area
• Your payment fails repeatedly after grace-period

9. Limitation of Liability

Tradynx, its operators, and affiliates are not liable for any trading losses, missed opportunities, technical failures, or consequential damages arising from use of this service. Maximum liability is limited to the amount of subscription fees paid in the last 30 days.
